Terms of Service

1. Acceptance of Terms
By accessing or using ORBTR's services, including the agent software, control plane, and website (collectively, the "Services"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Description of Services
ORBTR provides a cross-platform device management and SD-WAN platform consisting of: (a) the ORBTR agent software installed on managed devices; (b) the control plane and mesh backend for device administration; and (c) associated APIs, documentation, and support services.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately of any unauthorised access.
4. Subscription & Billing
Services are offered under tiered subscription plans as described on our pricing page. The Starter plan includes a 30-day trial with up to 25 devices, after which the free tier supports up to 9 devices. Additional devices and advanced plans are billed monthly. All fees are non-refundable except as required by law.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorised access to other tenants, devices, or systems
- Reverse engineer, decompile, or disassemble the agent software
- Interfere with or disrupt the Services or the mesh network infrastructure
- Use the Services to transmit malware, conduct attacks, or facilitate abuse
- Exceed rate limits or abuse API endpoints
6. Data Ownership
You retain all rights to your data. We do not claim ownership of any content, configuration, or telemetry data you generate through the Services. Our use of your data is governed by our Privacy Policy.
7. Security Responsibilities
You are responsible for the security of your tenant root keys, device enrollment tokens, and any credentials used with the Services. ORBTR provides cryptographic verification (dual-signed root descriptors, Ed25519-signed updates) but cannot guarantee security if your keys are compromised.
8. Service Availability
We aim to maintain high availability as described in our Service Level Agreement. Scheduled maintenance will be communicated in advance. The mesh architecture is designed for resilience — agents continue operating during control plane outages.
9. Intellectual Property
ORBTR and its licensors retain all intellectual property rights in the Services, including the agent software, control plane, protocols, and documentation. These Terms do not grant you any rights to our trademarks or branding.
10. Limitation of Liability
To the maximum extent permitted by law, ORBTR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
11. Termination
Either party may terminate the subscription at any time. Upon termination, your access to the control plane will cease. Device data will be retained for 30 days to allow export. We may suspend or terminate accounts that violate these Terms without notice.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Services after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of Australia. Any disputes shall be resolved through binding arbitration in accordance with applicable rules, unless either party seeks injunctive relief.
